Municipal Defence

Boghosian + Associates acts for numerous Ontario municipalities and their insurers.

Members of the firm are experienced in all manner of actions against municipalities in Ontario, including in respect of road and sidewalk non-repair, police liability, public transit liability, water and sewer back-ups and flooding, occupiers' liability, fire and ambulance liability, negligent building inspection, negligence and negligent misrepresentation in the planning and zoning process, defamation and abuse of public office.

The firm's lawyers have conducted numerous trials and appeals in the defence of Ontario municipalities, including many that have set important precedents in related areas of law.

Mr. Boghosian co-authored the leading national looseleaf text on municipal liability, The Law of Municipal Liability in Canada, which he updates annually. He is a consulting editor of a national, municipal risk management newsletter. He regularly speaks at legal and risk management seminars produced by a variety of municipal and risk management organizations, as well as the Ontario Bar Association and private sector conference producers.

General Municipal Litigation

Members of the firm have been retained to represent municipalities directly, such as by the Region of Waterloo and the Region of York, in the defence of challenges to by-laws, including those relating to smoking bans. They have also been retained to provide opinions and advice to in-house legal departments of municipalities, such as the City of Toronto, the City of Thunder Bay and the Town of Oakville, on a variety of issues, including tendering and procurement disputes. Mr. Boghosian has also been retained by a number of municipalities as well as candidates for public office in respect of Municipal Elections Act prosecutions and defences.

Tort and Insurance Defence

Members of the firm have been retained by insurers to defend a variety of general tort and insurance related claims, including products liability cases, commercial general liability cases involving occupiers' liability, errors and omissions claims and fidelity bond claims.

The firm acts for both insurers and plaintiffs in health and disability insurance claims.

Boghosian + Associates has also been retained to provide opinions concerning insurance coverage in a number of different areas.

Product Liability

The firm represents a variety of clients involved in product liability disputes, including those involving automobiles, public transit vehicles, building materials, heavy equipment, home appliances and furniture.

Commercial Litigation

Boghosian + Associates represents corporations and individuals in a wide range of commercial disputes, including those involving breach of contract, construction liens, negligent misrepresentation, intentional interference with contractual relations, breach of fiduciary duties, breach of the duty to act in good faith and defamation.

Employment Law

The firm acts for both employers and employees in wrongful dismissal and related disputes.

Estates Law

Members of the firm have acted in numerous estates matters on behalf of trust companies, individual estate trustees and beneficiaries or potential beneficiaries. They have conducted trials and applications which have established precedents with respect to issues such as the requirements for binding powers of attorney, undue influence and incapacity with respect to the execution of wills.

Plaintiff's Personal Injury

The firm acts for individuals who have been injured as a result of motor vehicle accidents, slip and falls, defective products and dangerous activities. The firm will not act against municipalities or their insurers.

Bankruptcy and Insolvency

Members of the firm have acted for creditors, trustees in bankruptcy and debtors in bankruptcy and restructuring proceedings including receiverships, opposed applications for bankruptcy orders (petitions), appeals from disallowance and related matters. The firm’s experience allows it to provide cost-effective representation for a wide range of services from attendances before the Registrar in Bankruptcy to complex matters on the Commercial List.

Construction, Condominium, Real Estate Litigation

Members of the firm have extensive experience in all manner of real estate, condominium and construction litigation acting for contractors, owners, property management companies, condominium corporations, purchasers and vendors. The firm has expertise in the application of and compliance with the Ontario Building Code, thus allowing it to provide superior legal services to a diverse range of clients.

Creditors’ Remedies and Mortgage Enforcement

Members of the firm have acted for secured lenders enforcing creditors’ remedies against real estate and personal property with an emphasis on providing clients with cost-effective, results-driven representation.
